MDE e-Permits
Welcome to the online Maryland Department of the Environment (MDE) e-Permits interface, established for projects that disturb one or more acres of earth that must apply for coverage under a Permit for Stormwater Associated with Construction Activity, and obtain coverage under that permit before beginning earth disturbance on any part of the project. Projects that initially disturb less than one acre, but that are part of a plan of development that will ultimately disturb one acre or more, must also obtain coverage before beginning earth disturbance on the first part of the project.
Once you have a user account, this online interface allows you to perform the following actions:
- Submit Declaration of Intent (DOI) [NEW]*
- Submit Notice of Intent (NOI)
- Upload supporting documents such as plans
- Pay permit fees
- Transfer of ownership
- Increase the disturbed acreage
- Withdraw a request
- Terminate coverage
NOTICE - Change in Required Documentation
A new approval process is in place for customers submitting an NOI for the General Permit for Stormwater Associated with Construction Activity.
In recognition that the permit is beyond its five-year term, and in recognition that NPDES permits have a maximum duration of five years, the Department is discontinuing the acceptance of new registrations under the stormwater associated with construction (14-GP) activity General Permit. Proposed new discharges of stormwater will not be allowed to obtain general permit coverage until a new permit is issued.
In place of permit coverage under the expired permit, the Department has issued a Consent Order to cover proposed new discharges of stormwater associated with construction activity. The applicant should submit a Declaration of Intent (DOI) and complete the electronic registration/certification process in accordance with the requirements otherwise set forth for registrations under expired permit 14-GP.
Coverage under the Consent Order will be effective upon your acceptance of the Declaration of Intent (DOI) and approval of the Notice of Intent (NOI) by the Department. Unless otherwise withdrawn or revoked, the Consent Order shall remain in full force and effect for you until the deadline for new registrations required under a new general permit, or the date you obtain coverage under an individual permit or general permit, whichever occurs first.
Please note that applications submitted prior to the expiration date of 14-GP (December 31, 2019) do not require submission of a Declaration of Intent (DOI) and will continue to be valid.
Process for Obtaining Approval under the Notice of Intent (NOI)
- Prior to submitting an NOI, the person(s) responsible for the project must submit a final erosion and sediment control plan to the appropriate approval authority (such as the Soil Conservation District).
- Submit complete NOI to MDE, including vicinity map, workers compensation insurance information (required for certain types of organizations), and fee. Local and State government projects do not pay the fee. Please see the MDE webpage for more information about whether a fee is due from certain projects continuing permit coverage from previous General Permits. The interface calculates the appropriate fee for the total disturbed acreage. If, for some reason, a refund must occur, MDE staff must complete that outside the interface. Please contact MDE for assistance.
- MDE reviews the NOI for completeness. If MDE determines that information in the NOI requires review and/or correction by the submitter, MDE returns the NOI through the interface. The submitter receives an email noting the return. Once the NOI is complete, MDE staff accept it, and the NOI enters the public notification period.
- Each accepted NOI is shown on the public website for the MDE e-Permits interface for 14 days. During this time, citizens may ask to review the available erosion and sediment control and stormwater management plans at the approval authorities for those plans.
- If MDE receives, prior to the expiration of the public notice period, a request from any person that the site be required to obtain an individual permit with a detailed, written explanation as to why the Erosion and Sediment Control Plan fails to meet State erosion and sediment control or stormwater management standards, MDE will do the following: (i) notify the applicant that a request that an individual permit be required has been received, (ii) evaluate the information, and (iii) make a decision and send notification of that decision to the NOI submitter and the person requesting that an individual permit be required. If MDE receives no such request, MDE will issue the project coverage under the Consent Order after the public notice period expires and MDE receives documentation that the erosion and sediment control plan has been approved by the appropriate approval authority. Applicants may log in and attach the plan approval documentation to the electronic NOI at any time, even if the public participation period has not yet expired.

This electronic government service includes a 3% service/convenience fee for credit card payments or $3 eCheck fee processed through this online service. This fee is assessed by NICUSA, Inc., Maryland's eGovernment service provider, a third party working under a contract administered by the Maryland Department of Information Technology (DoIT). The service fee is used to develop, maintain, and expand the online service offerings of the state and is non-refundable. Accepted credit cards: Visa, MasterCard, Discover and American Express.
